1. Description of Service
NewtJobs operates solely as an online technology platform that enables employers to post job opportunities and job seekers to discover and apply for positions. NewtJobs is not an employer, recruiter, staffing agency, or employment broker, and does not participate in hiring decisions, employment negotiations, or workplace arrangements.
2. Platform Status
NewtJobs provides a marketplace technology platform. We facilitate discovery and connections between employers and job seekers. We do not endorse any employer, job seeker, listing, or application submitted through the platform.
3. User Accounts
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate, current, and complete information when registering.
4. Employer Responsibilities
Employers are solely responsible for ensuring job postings and hiring practices comply with all applicable employment laws and regulations. Employers may not post fraudulent, misleading, discriminatory, or unlawful listings.
5. Job Seeker Responsibilities
Job seekers are responsible for the accuracy of resumes, credentials, work history, and profile information submitted through the platform. Users are responsible for conducting their own due diligence before pursuing any employment arrangement identified through NewtJobs.
6. Prohibited Use
You may not use the platform for any unlawful purpose, to post false or misleading content, to harass or harm other users, to scrape or harvest data, or to circumvent any platform security measures. See our Acceptable Use Policy for a full list of prohibited conduct.
7. User Content
All job listings, resumes, applications, profiles, and communications are created and provided by users. NewtJobs is not responsible for the accuracy, legality, reliability, or completeness of user-generated content.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
9. Limitation of Liability
To the fullest extent permitted by law, NewtJobs shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of employment opportunities, lost profits, or reputational harm, arising out of or related to the use of the platform.
In no event shall NewtJobs's total cumulative liability to any user exceed the total amount paid by that user to NewtJobs in the twelve (12) months immediately preceding the event giving rise to the claim, or $100 USD if no fees have been paid.
10. Employment Relationship Disclaimer
Any employment relationship formed through the platform exists solely between the employer and the job seeker. NewtJobs is not a party to any such arrangement.
11. Arbitration, Class Action Waiver, and Jury Trial Waiver
Any dispute arising out of or relating to the platform or these Terms shall be resolved by binding arbitration conducted on an individual basis in Frederick County, Maryland, under the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: All disputes must be brought on an individual basis. Users waive any right to participate in class, collective, or representative actions, whether in arbitration or in court.
Jury Trial Waiver: To the fullest extent permitted by law, both parties expressly waive any right to a trial by jury in any action, proceeding, or counterclaim arising out of or relating to the platform or these Terms.
12. Termination
NewtJobs reserves the right to suspend or terminate your account and access to the platform at any time, for any reason, including violation of these Terms, without notice or liability.
13. Subscriptions and Billing
Certain features of the platform require a paid subscription. All fees are stated in U.S. dollars. Subscriptions renew automatically at the end of each billing period unless canceled prior to renewal. NewtJobs may modify pricing at any time with reasonable notice.
Refund Policy: If you cancel your subscription within three (3) days of your initial purchase and have not used any premium AI features (resume optimization, cover letter generation, or match analysis), you may be eligible for a refund to your original payment method, which will be processed within a few business days of cancellation. Cancellations after 3 days, or following any premium feature use, are generally non-refundable; you will retain access through the end of the current billing period. NewtJobs reserves the right to modify pricing at any time with reasonable notice. You are responsible for all charges incurred under your account. Refund eligibility is determined at NewtJobs's sole discretion.
14. Changes to Terms
NewtJobs may update these Terms from time to time. Material changes will require re-acceptance before continuing to use the platform. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-law principles. Any non-arbitrable disputes shall be resolved exclusively in the state or federal courts located in Frederick County, Maryland.
